Detained persons have right to bail on holidays and weekends

A statement on the Facebook page of the Ghana Police Service states that detained persons have right to bail on holidays and weekends. 

The long-standing belief that detained people cannot be released on bond during particular times, such as holidays and weekends, and must instead be remanded in detention until the following day or week has been debunked by the Ghana Police Service.

The law enforcement organization unequivocally said that the aforementioned perception is incorrect in a statement published on its Facebook page on Sunday, August 14, 2022.

“We wish to state categorically that there is no such principle or rule that forbids the Police or clothe the Police with the authority not to grant bail at night. The Administration further wishes to state that BAIL is a constitutional right of arrested persons and can be granted at any time of the day, including holidays and weekends,” the statement read.

The Service claimed that such an impression is the result of a lack of knowledge of the country’s legal system and added that it lacks the authority to deny bail to anyone in its custody who is eligible for it.

The police’s remark was in reaction to assertions made by Adam Bantima Samba, the chairman of the Northern Regional NPP, that the police have a rule against issuing or dispensing bail late at night.

“The attention of the Police Administration has been drawn to a social media publication in which the Northern Regional NPP Chairman, Adam Bantima Samba is seen making a claim to the effect that he will make a record by breaking Police principle of not granting or administering bail at night.

“The statement made by Mr. Samba is erroneous and a clear demonstration of ignorance of the law on his part and the public should therefore treat it with the contempt it deserves.”
